Can the notary sign if the patient in the hospital is unconscious?
No. If a patient is unconscious or not alert, it is strictly prohibited by Florida law for a notary to notarize documents on their behalf. The patient must be able to acknowledge what they are signing. Note: Travel fees still apply if we arrive and the patient cannot sign.
Can I bring my own witnesses to the hospital?
Yes! Florida law requires two witnesses for Living Wills and Power of Attorney forms. You may bring your own, but they must be 18+ years old, have NO financial interest in the documents, and cannot be an immediate blood relative or spouse of the patient. If you cannot provide witnesses, we can supply them for an additional fee.
